Our territories are defined by a salesperson’s logistical reach and contact cultivation. We are open to expanding territories If the accounts can be successfully developed and maintained. Participants will be given a revised quota due to a change in accounts or territory during the fiscal quarter. If a section of territory is not developed within a quarterly time span, the territory has the potential to be split. Any established customers will split commission with the new salesperson forthe term of 1 year, subject to all other terms and conditions in this plan. Future calculations will be based on the new account/territory. Account and territory changes are effective for the entire month. There are no mid-month changes. Changes to quota, accounts or territories will be made in writing to the participant.
If a participant’s monthly sales consecutively drop below set goals, we will reach out to discuss strategies for improvement. If sales do not improve in the following months, the participant’s territory is subject to revision. Our goal is to help you grow, so we will use all the tools at our disposal to assist.
As an independent sale participant, you are not an employee of Peel and Stick Wall Murals. We are contracting your sales services with monthly compensation, based on a percentage of sale volume. Should our sales partnership grow and prove highly beneficial to both parties, a full-time salary/commission split could be offered if desired.
Participants who transfer to a new plan will continue to earn any incentives for all the business credited through the effective date of the change, subject to all standard terms and conditions of this Plan. Future commission payments will be according to the terms and conditions of the new plan. All changes will be effective for the full month at the point of change. Changes to plans will be made in writing to the Participant.
Occasionally it is necessary to change quota. Quotas are effective for the full month of the point of change. There will be no partial month quota changes. All future commission and bonuses earned will be calculated based on the new revised quota. Changes to quotas will be made in writing to the Participant.
We have no plans to adjust the commission rates anytime soon. But if the time comes to adjust the rate up or down, they will be issued in writing and will not become effective until the following month, with a minimum two-week notice. There will be no partial month rate changes. There is no retroactive change for commissions earned. All future commissions earned will be calculated based on the new revised rates.
Participants who voluntarily or involuntarily end their agreement with Peel and Stick Wall Murals, whether or not for cause will be paid all commission payments earn up to the end of the month. Should the participant choose to conclude all business prior to the end of the month, a written request must be submitted with a termination date. A check will be issued within 48 hours of the termination dated and mailed out to the participant.
Should there be any questions of interpretation regarding payments or earned amounts, the final authority for interpretation will reside with the Sales Manager and Owner.
As an independent sales representative, you will be responsible for paying taxes for all earnings. A 1099 form will be mailed out at the end of the year. As a self-employed taxpayer, you are entitled to many business-related deductions. We would be happy to suggest a list of tax savings opportunities.
If any term or condition of this Plan is found to be in non-conformance with a given state or federal law that term or condition will be non-enforceable but will not negate other terms and conditions of the Plan. However, the company will review and modify the overall plan to conform to such laws.
Draw is a cash advance for a participant upon request. Any draw is made monthly, paid on the 15th and can be no more than 25% of the previous month’s commission earnings. A draw must be established a minimum of one month in advance. The draw will then be deducted from the earned commission for that period.
When a participant is overpaid earnings, the participant is obligated to repay Peel and Stick Wall Murals or defer the balance to the following month(s). Overpayments can result from an order cancellation, return under policy, or other related causes. The overpayment is a liability of the participant until it is fully repaid.
All disputes which involve claims for $3,000 or more, and which arise out of the participant's termination thereof, whether or not such claims are based exclusively on the terms of this plan, and parties are unable to resolve their dispute within thirty (30) days after exercising good faith efforts, shall be submitted to binding arbitration. The parties agree that after arbitration has been initiated; all other civil actions between the parties shall be stayed until after the arbitration proceeding is concluded.
The arbitrators shall honor the terms and conditions of the terms and policy of this document. The arbitration shall be binding on the parties and be honored by them without resort to any further court proceedings. Neither party may demand arbitration or institute any lawsuit in any form arising out of this plan more than two (2) years after the claim or cause of action has arisen.
